Lease of land in Brentford for a charity school

This deed, numbered 17805 in the collection, records a land transaction in 1725. The 98-year lease was taken by a group of men from  Brentford and Kew who were effectively the trustees of the charity school. A transcript of the full text follows:

This Indenture Made the thirtieth day of August in the twelfth year of the raign of our Soveraigne Lord George by the grace of God of great Britaine France and Ireland King Defender of the Faith &c anno Dni One Thousand Seven hundred twenty & Five

Between John Rogers of Brentford Butts in the parish of Hanwell in the County of Middx Gent of the one part, and the Reverend Thomas Vincent Rector of Hanwell aforesd the Reverend John Calvert & William Chilcott of Brentford Butts aforesd Edward Rogers of Brentford Butts aforesd Gent Edward Browne of Brentford Butts aforesd Gent John Tong and Henry Vaughan of New Brentford in the said County of Middlesex The Reverend Hugh Lewis of Kew Green in the County of Surrey Master of Arts, Christopher Appleby Capel Appleby and George Willson of Kew Green aforesaid Gentlemen Trustees Nominated and Appointed In Trust for and on behalfe & to the use and benefit of the Charity Schoole scituate in Brentford Butts afores of the other part

Witnesseth that the said John Rogers For a consideration of the Rents Covenants and Agreemts hereinafter reserved menc(i)oned & contained on the part and behalfe of the s(ai)d Thomas Vincent John Calvert William Chillcott Edward Rogers Edward Browne John Tong Henry Vaughan Hugh Lewis Christopher Appleby Capel Appleby & George Willson their Executorers Adm(instrato)rs & Assignes to be paid done and performed Hath Demised granted to Farme Letten and by these p(re)sents Doth Demise grant and to Farme Lett unto them the said Thomas Vincent John Calvert William Chillcott Edward Rogers Edward Browne John Tong Henry Vaughan Hugh Lewis Christopher Appleby Capel Appleby & George Willson their Executorrs Adm(instrato)rs & Assignes In Trust for & to the use of the said Charity Schoole

All that piece or parcel of Ground containing by Estimac(i)on from East to West Sixty Feet (be the same more or less) & from North to South twenty one Feet (little more or less) Scituate Lyeing & being on the North Part of the said Charity Schoole in Brentford Butts afores(ai)d and abutting on other land of the said John Rogers on the North and Brentford Butts on the West upon the land late in the poss(ess)ion of Anne Slightholme on the East and upon the land of the Said Charity Schoole on the South together with all Wayes Passages Waters and Watercourses profits comodityes & appurt(enance)s unto the s(ai)d piece or parcell of Ground belonging or in any wise appertaining To have and to hold the s(ai)d piece or parcell of Ground and premises afores(ai)d with all and singular the appurt(enance)s unto the s(ai)d Thomas Vincent John Calvert William Chillcott Edward Rogers Edward Browne John Tong Henry Vaughan Hugh Lewis Christopher Appleby Capel Appleby & George Willson their Executorrs Adm(instrato)rs & Assignes, from the Feast day of the Annunciation of the Blessed Virgin Mary last past for and during & unto the full End and terme of ninety-eight yeares from thence next ensueing & fully to be compleat & Ended

Yeilding and paying therefore yearly paym(en)ts (that is to say) at the Feast Dayes of St Michael the Archangel and the Annunciation of the blessed Virgin Mary And they the s(ai)d Thomas Vincent John Calvert William Chillcott Edward Rogers Edward Browne John Tong Henry Vaughan Hugh Lewis Christopher Appleby Capel Appleby & George Willson doe for themselves severally and respectively & for their several and respective Executorrs Adm(instrato)rs & Assignes Covenant promise and agree to which the said John Rogers his Executorrs Adm(instrato)rs & Assignes by these pr(e)sents in manner & Forme following (that is to say) that they the said Thomas Vincent John Calvert William Chillcott Edward Rogers Edward Browne John Tong Henry Vaughan Hugh Lewis Christopher Appleby Capel Appleby & George Willson their Executorrs Adm(instrato)rs & Assignes some or one of them shall & will from time to time and at all times hereafter during the said terme above granted well & truly pay or caused to be paid into the s(ai)d John Rogers his Executorrs Adm(instrato)rs & Assignes the s(ai)d yearly Rent or Sum(m)e of Twenty Four Shillings above reserved at the dayes and times above limited and appointed for the paym(en)t thereof during the s(ai)d terme

And also that they the said Thomas Vincent John Calvert William Chillcott Edward Rogers Edward Browne John Tong Henry Vaughan Hugh Lewis Christopher Appleby Capel Appleby & George Willson their Executorrs Adm(instrato)rs & Assignes or their successors shall and will w(i) thin six moneths next ensueing the date of these presents at their some or one of their owne proper costs and charges well and substantially erect build & sett up in good workmanlike manner a substantial Brick Wall all along the said peice of Ground hereby Demised from the East End to the West End thereof & likewise from North to South fronting the Butts pitt & from the South up to the North West Corner of the s(ai)d schoole & shall & will from time to time and at all times hereunto during the s(ai)d terme hereby demised well & sufficiently repaire support uphold amend & keep the s(ai)d brick wall in by & with all & all manner of needful & necessary Reparac(i)ons & amendm(en)ts whatsoever & at the End or other sooner determination of this pr(e)sent Demise the same being soe well and sufficiently Repaired Supported upheld amended & Kept shall & will peaceably & quietly leave Surrender & yeld up unto the s(ai)d John Rogers his Executorrs Adm(instrato)rs & Assignes

Provided always that if it shall happen the said yearly Rent of Twenty four Shillings or any part thereof to be behind or unp(ai)d in part or in all by the space of Fourteen dayes next over or after any of the s(ai)d Feast dayes or dayes of paym(en) t whereon the same ought to be paid as afores(ai)d being Lawfully demanded) That then & from thenceforth it shall and may be Lawfull to and for the s(ai)d John Rogers his Executorrs Adm(instrato)rs & Assignes to go into the s(ai)d demised pr(e)mises and every or any part thereof in the Name of the whole wholly to reenter & the same to have againe retaine repossess & enjoy as in his & their first and former Estate and Estates & the s(ai)d Thomas Vincent John Calvert William Chillcott Edward Rogers Edward Browne John Tong Henry Vaughan Hugh Lewis Christopher Appleby Capel Appleby & George Willson & all other Occupyer or Occupyers of the pr(e)mises thereon & from then utterly to Expell Putt out & amove This I(n)d(ent)ure or anything therein contained to the contrary thereof in any wise notwithstanding And the s(ai)d John Rogers for himselfe his Executorrs Adm(instrato)rs & Assignes doth Covenant promise & agree to & with the s(ai)d Thomas Vincent John Calvert William Chillcott Edward Rogers Edward Browne John Tong Henry Vaughan Hugh Lewis Christopher Appleby Capel Appleby & George Willson their Executorrs Adm(instrato)rs & Assignes that they paying the s(ai)d yearly Rent of Twenty four Shillings above referred & Observing performing Fulfilling & Keeping all & singular the Covenants grants Clauses Prtovisos and Agreem(en)ts hereinbefore contained on the Tenants or lessees part & behalfe to be done performed & kept shall or Lawfully may peaceably & quietly have hold use Occupy possess & enjoy the s(ai)d piece or parcell of Ground above Demised & all and singular other the the s(ai)d piece or parcell of Ground
